Data Processing

Sub-Processor List

BusinessGuard engages the following third-party sub-processors to assist in the delivery of the Service. Each sub-processor is contractually bound to process Personal Information solely as instructed by the Company and in accordance with applicable data protection obligations.

Waitlist-Stage Notice

BusinessGuard is currently operating in pre-launch waitlist mode. The Service is not yet generally available. During the waitlist period, the only Personal Information collected from waitlist registrants is the business email address and business name, which are used solely to deliver pre-launch communications. References in these policies to features such as report submission, moderation workflows, audit trails, and cookie preference interfaces describe the Service as it will operate upon general availability launch and do not represent features that are currently active.

Purpose: Rate limiting, caching, and abuse prevention.

Data Categories: Request metadata, IP addresses, rate-limit counters, ephemeral session identifiers.

Resend, Inc.

Resend, Inc. is located in United States.

Purpose: Waitlist communications and product email delivery.

Data Categories: Email address, business name.

Cloudflare, Inc.

Cloudflare, Inc. is located in United States.

Purpose: Bot protection and CAPTCHA verification (Turnstile).

Data Categories: Device and browser metadata, interaction patterns, IP address, challenge tokens.

Vercel, Inc.

Vercel, Inc. is located in United States.

Purpose: Application hosting, edge delivery, and serverless compute.

Data Categories: Request logs, edge routing metadata, deployment artifacts, performance telemetry.

Change Notification Policy

1. Advance Written Notice

The Company shall provide not less than thirty (30) calendar days' advance written notice to all active Account holders prior to the engagement of any new Sub-Processor or the material modification of an existing Sub-Processor's scope of processing. Such notice shall be transmitted via electronic mail to the address associated with the User's Account and shall identify the Sub-Processor, the categories of Personal Information to be processed, and the purpose of such processing.

2. Objection Process and Remedies

Users who object to the engagement of a new Sub-Processor or to the modification of an existing Sub-Processor's processing scope may submit a written objection to privacy@thebusinessguard.com within thirty (30) calendar days of the date of the Company's notification. The Company shall review all timely objections in good faith and shall, where commercially reasonable, work with the objecting User to address the stated concerns. In the event that the Company is unable to resolve the objection to the User's reasonable satisfaction, the User may, as its sole and exclusive remedy, terminate its Account and the associated Subscription in accordance with the termination provisions set forth in the Terms of Service, and the Company shall issue a pro-rata refund of any prepaid, unused Subscription Fees.

Objection window: 30 calendar days from the date of the Company's change notification.

All sub-processors are contractually required to implement and maintain technical and organizational security measures at least as protective as those described in the Company's Privacy Policy. No sub-processor shall process Personal Information for any purpose other than the specific purpose designated by the Company.
